New OPG guidance  on use of client accounts for  deputyship funds

17/2/2016

The Office of the Public Guardian’s (OPG) has issued a practice note concerning the use of client accounts to manage deputyship funds, and how the deputy should act under the Mental Capacity Act 2005 (MCA), the Solicitors Regulation Authority Accounts Rules 2011 (SARs) and the MCA Code of Practice.

The practice note makes clear that the OPG that has "no objection in principle" to the use of general client
accounts as a temporary or holding position but reminds solicitors of their duties with regards other regulators and to the client themselves.

The note can be downloaded from the OPG site here.
