New case alert: North Yorkshire County Council v MAG & Ors [2015] EWCOP 64

The LA was seeking an authorisation of the P's deprivation of liberty in circumstances where his current placement involved a deprivation of liberty and that there was no immediate alternative residential option. It sought the authorisation on the basis that it was justified as a result of his condition which rendered the restrictions proportionate and necessary. The court refused the authorisation.
