Z [2018] EWHC 1488 (Ch)

The nephew of the P was seeking to be joined to the main proceedings which would determine whether or not the P had capacity. The application was refused.

The nephew of the P, who had strong personal and  business with him, was seeking to be joined as a party to the main proceedings, which were to determine the capacity or otherwise of the P.  He alleged that the wife of the P had blocked payments to himself from the P for no apparent reason. The application was resisted by the wife .

The court refused the application and directed that the Applicant's witness statements in the procedural application shall stand as evidence in the main proceedings.
