Application brought by the Local Authority seeking declarations and orders to enable safeguarding of AW, a 35-year old man living in residential care placement but where there are concerns about his capacity to decide on sexual relationships and other matters.
Application by the P's daughter for an order that it was in her mother's best interests to be allowed to leave the care home in which she was currently living and move to live with her daughter and her family. The court agreed that it was in the P's best interests that she should live with her daughter.
Does the Court of Protection have the power to grant injunctive relief? Yes, said the court.
