PBC v JMA & Ors [2018] EWCOP 19

3/9/2018

Application by the P's son to receive authority from the court to make gifts from the P's estate in the sum of £7m.  The authorisation was granted.
The application was brought so that inheritance tax would be reduced if the P survived for at least 3 years after the gifts were made. The court ruled that the factors in favour of the proposed gifts outweighed the factors against. In the context of the wider agreement between the parties, the court was satisfied that the proposals were in the best interests of the P.
