Application by ICB to extend an injunction designed to project MK from being directly exposed to conflict between AK, her son, and the siblings or carers. MK is now an 81 year old Muslim woman and the injunction was originally granted in 2014. It had remained in place to this date but was up for renewal in February 2024. Under the terms of the order AK was, broadly, prevented from visiting MK outside specified time and forbidden from instructing anyone to assess MK without prior authority.
DJ Geddes renews the injunction, despite the lateness of the ICB’s application. Making it plain at [26] that the Court has the power to protect and support best interests decisions made for P. This is in part because AK still resist the medical treatment In the face of Ak’s continued rejection of MK’s medical treatment and intends “to subject his mother to an assessment, whether physical or not and that doing so without some form of consensus would be harmful to MK. The reality here is that there is an extensive team around MK who are far better acquainted than AK is about her current progression and presentation.” [41] In this light he also agrees to the request of the ICB and the OS to renew it for an unlimited duration.
