Application by the LA to authorise the P's removal from her home and her transfer to a residential care home, at least for an interim period. The application was granted. The P has dementia and lacks capacity to conduct this litigation and to make decisions about her residence and care. Over recent months she has been living at home with her son, the Second Respondent. His behaviour has given rise to increasing concern causing the Local Authority to apply to the court to authorise her removal from her home and her transfer to a residential care home, at least for an interim period. The son has a history of violence and drug use, he becomes agitated, he is hostile to social workers and other visitors to the house, and he is determined to isolate the P and to be the only one who has contact with her.
The Court of Protection agreed that the P should be moved to a residential home, at least for an interim period. Read the full text of the judgment on Bailii Comments are closed.
