Application against various costs orders made against the applicant in relation to the P, his late aunt. The application was dismissed. This application related to certain costs orders against Mr Fitzgerald in the Court of Protection. Those proceedings related to Mr Fitzgerald's now deceased aunt A, a patient whose affairs were under the control of the Court of Protection until her death on 5 March 2018. Central to Mr Fitzgerald's application were the circumstances in which, in the course of those proceedings, SJ Lush, by an order dated 28 May 2013, had appointed her niece, C, to be A's deputy for property and affairs. Mr Fitzgerald had already made at least 23 applications to the COP and had bombarded all and sundry with an enormous number of emails since 2013.
The COP dismissed Mr Fitzgerald's application as it was, in all respects, totally without merit. Read the full text of the judgment on Bailii Comments are closed.
