Powys Teaching Health Board & Anor v NT & Anor [2025] EWCOP 44 (T3)

Reasons given for best interests decision that NT should undergo a medical process to treat his possible bladder cancer.
NT is a 41 year old with paranoid schizophrenia. In March 2025, he complained of pain in his kidneys. A CT scan showed possible tumours and an emergency procedure was recommended to remove them. However NT declined the procedure and there was confusion over his capacity so the Trust made this application. 

Theis J, the Vice President, announced the proposed treatment was in NT's best interests at the end of the hearing and in this judgment sets out the reasons for that decision. She notes that it was agreed NT lacked capacity but that his wishes had vacillated. There was also concern that any forced treatment would strain his relationship with his carers. However the need for the treatment was unchallenged and so the need to preserve life meant it was in NT's best interests.
