Applications for welfare orders where P's relationship with her mother was a cause for concern P is a 20-year-old woman with a diagnosis of learning disability, autism and global developmental delay. An earlier judgment stated that she lacks capacity to litigate these proceedings and to make decisions about her residence, care and support and contact with others. P had been placed in respite care by the LA as they had concerns over P's mother, A, over both her behaviour towards their social workers and her relationship with another man.
After an exhaustive review of the evidence of the parties involved, Owen J concludes that, even though her family are important to her, P should remain in her placement partly as P's grandmother agreed she could not live with her mother and partly as any move could jeopardise P's enjoyment of college, which she loves.
